These Terms and Conditions govern access to the MYITG website and the business communication services supplied by MYITG DIGITAL SDN. BHD. (Registration No. 202601013092 / 1675190-V). By placing an order, signing a Service Order, opening an account or using a Service, you agree to these Terms.
1. Definitions
“MYITG”, “we”, “us” or “our” means MYITG DIGITAL SDN. BHD. (Registration No. 202601013092 / 1675190-V). “Customer”, “you” or “your” means the person or organisation ordering or using a Service. “Agreement” means these Terms together with any quotation, Service Order, product description or service-level agreement accepted by the Customer. “Service” means the communication, software, subscription, messaging, equipment or related service supplied by MYITG. “System” means the equipment, network, software, facilities, numbers, accounts, credentials or connections used to provide a Service.
2. Acceptance and effective date
The Agreement takes effect when MYITG accepts your application or order, activates the Service, or both parties sign or otherwise accept the relevant Service Order. Website use is also subject to these Terms from the time you access the website.
3. Scope and commencement of Services
MYITG provides business communication services including Cloud PBX, VoIP, SIP Trunking, SMS, Voice and WhatsApp messaging, outbound communication tools, related software and equipment. The features, limits, fees and minimum commitments applicable to a Service are those shown in the accepted quotation, Service Order, checkout page or product description.
Billing begins on the activation or commencement date stated in the Service Order or, if no date is stated, when the Service is made available for use. Installation and activation remain subject to technical feasibility, required approvals and the Customer performing its obligations.
4. Charges and payment
- All charges are payable in Malaysian Ringgit (MYR). Prices exclude SST and other applicable taxes unless expressly stated otherwise.
- Invoices must be paid within fourteen (14) days of the invoice date unless a different payment period appears in the Service Order.
- Subscriptions may be billed monthly or annually in advance. Usage charges and prepaid credits are billed as described for the relevant Service.
- MYITG may apply a payment received against any overdue amount owed by the Customer. Cheque payments are credited only after clearance.
- Where permitted by the Agreement and applicable law, overdue sums may incur a late charge of up to 1.5% per month until paid.
- A deposit may be required as security. Any refundable balance may be applied against outstanding charges before it is returned.
5. Customer obligations and acceptable use
You must provide accurate information, pay all charges when due, follow reasonable technical and operational instructions, and comply with all applicable Malaysian laws, MCMC requirements and third-party platform policies. You must not use a Service for fraud, harassment, unlawful content, unauthorised access, unsolicited communications or any activity that disrupts a network or infringes another party's rights.
You are responsible for obtaining recipient consent for campaigns, maintaining lawful contact lists, securing your accounts and credentials, and all activity conducted through your account unless caused by MYITG's breach. You must notify us promptly of suspected unauthorised use, a security incident or a change of service premises or contact details.
6. Equipment, connectivity and compatibility
Unless expressly included in the Service Order, the Customer is responsible for suitable internet access, electricity, internal wiring, sockets, devices and third-party equipment. MYITG is not responsible for faults or degraded quality caused by incompatible, unauthorised or third-party equipment or connectivity outside our reasonable control. You must disconnect equipment when reasonably requested for safety, testing, maintenance or regulatory reasons.
7. Service availability, maintenance and changes
We may interrupt, suspend, modify or upgrade a Service for planned maintenance, emergency work, security, fault investigation, network changes or compliance with a lawful direction. We will provide reasonable notice where practicable. Any specific service-level commitment applies only when stated in a separate Service Order or SLA.
8. Suspension and termination
MYITG may suspend or terminate all or part of a Service if charges remain unpaid, information supplied is false or materially incomplete, the Customer breaches the Agreement, uses the Service unlawfully or unsafely, creates a security or network risk, becomes insolvent, or where suspension is required by law, a regulator or an upstream provider.
Unless the Service Order specifies a minimum term or different notice period, the Customer may terminate a recurring Service by giving at least thirty (30) days' written notice. Charges remain payable through the effective termination date, including usage, committed charges, equipment, early-termination charges and other accrued amounts. Reconnection may be subject to settlement of arrears and a reasonable reconnection fee.
9. Refunds and returns
Refunds, credits and returns are governed by our Refund Policy, the applicable Service Order and mandatory rights under Malaysian law. Cancellation does not automatically entitle the Customer to a refund for a billing period already started or work already performed.
10. Privacy and confidentiality
We handle personal data in accordance with our Privacy Policy and applicable Malaysian data protection law. Each party must protect the other's confidential information and may disclose it only where necessary to perform the Agreement, with consent, or where required by law or a competent authority.
11. Intellectual property and website use
MYITG and its licensors retain all intellectual property rights in the website, software, documentation, branding and Services. We grant the Customer a limited, non-exclusive and non-transferable right to use the Service during the Agreement. You must not copy, reverse engineer, resell or misuse the Service except where expressly authorised in writing or permitted by law.
12. Limitation of liability
To the maximum extent permitted by law, MYITG is not liable for loss of profit, revenue, goodwill, data, anticipated savings or any indirect, incidental, special or consequential loss. MYITG is not responsible for interruptions or failures caused by customer systems, internet providers, telecommunications carriers, third-party platforms, cyber incidents despite reasonable safeguards, or events beyond our reasonable control.
Where liability cannot lawfully be excluded, MYITG's aggregate liability relating to the affected Service is limited to the fees paid for that Service during the one (1) month immediately preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
13. Force majeure
Neither party is liable for delay or failure caused by events beyond its reasonable control, including natural disaster, fire, flood, epidemic, war, civil disturbance, government action, power or internet failure, carrier or interconnection failure, labour disruption or failure of an upstream service. The affected party must take reasonable steps to reduce the impact and resume performance.
14. Notices
Notices may be delivered personally, by email, or by prepaid or registered post to the most recent address supplied by the receiving party. The Customer must keep its account and contact information current. Operational and service notices may also be provided through the account portal or website.
15. Amendments
MYITG may update these Terms or a Service where reasonably required for legal, regulatory, security, technical or commercial reasons. Material changes will be communicated by email, account notice or publication on this website. Continued use after the effective date constitutes acceptance, subject to any rights available under the Agreement or applicable law.
16. Assignment
The Customer may not assign or transfer the Agreement without MYITG's prior written consent. MYITG may assign the Agreement as part of a restructuring, financing, sale of business or transfer to an affiliate or service provider, provided this does not materially reduce the Customer's rights.
17. Severability and waiver
If a provision is found invalid or unenforceable, it will be limited or removed only to the extent necessary and the remaining provisions will continue in effect. A delay or failure to enforce a right is not a waiver of that right.
18. Governing law
The Agreement is governed by the laws of Malaysia. The parties submit to the jurisdiction of the Malaysian courts, without limiting any mandatory dispute-resolution or consumer rights that apply.
